Whose IDEA is This?
A new version of Whose IDEA Is This? A Resource Guide for Parents (updated June 14, 2010) is available for use by districts in Ohio. This guide serves as the Procedural Safeguards Notice in accordance with 34 CFR 300.504. The USDoE, Office of Special Education Programs (OSEP) requires that a copy of the procedural safeguards notice shall be given to the parents of a child with a disability, at a minimum, upon referral for evaluation; upon each notification of an IEP meeting; upon reevaluation of the child; upon receipt of a request for due process as required by paragraph (C)(5)(c) of Rule 3301-51-08 of the Administrative Code; and upon a change in placement for disciplinary action. Districts should note requirement to provide a copy of the procedural safeguards notice upon each notification of an IEP meeting.
